Data protection policy

This data protection policy outlines how FBD International, SAS with a capital of 500,000.00 euros whose head office is located 5 Rue de la Haye, The Dome Roissy Pole Airport CDG, 93290 Tremblay-en-France, registered in the Register of Commerce and Companies of Bobigny under the number 410 917 439 (hereafter "FBD")  processes your personal data.

 

  1. General Information - Definitions

Through this FBD data protection policy, FBD explains transparently how it handles your collected personal data:

  FBD's data processing  is carried out in accordance with the European Regulations 2016/679 of 27 April 2016 and the Computer, Files and Freedoms Act No.78-17 of 6 January 1978 in its amended version (the "Regulation").

 

The term "Donnée"   used in capital letters as part of this data protection policy refers to any information that directly or indirectly, alone or through cross-referencing  with other information, to identify a natural person.

 

  1. How does FBD collect your data  - Who is the person in charge of processing it?

 

2.1. FBD  can collect your data directly from   you when you  share it with you through:

  • Request  for contact on its website; 
  • Social networks
  • applications made by you in order to integrate FBD or one of its network heads as an employee (Cuisine Plus  France,  FBD Export,  GIMAC (network Cuisines References), Ixina France, Ixina Belgium, VDBK  (hereafter our "Signs");  
  • applications made by you in order to integrate an independent store member of one of our networks (Cuisine Plus, Cuisines References, Ixina, VDBK   (hereafter the  "Networks").

 

Depending on the purpose of the treatment involved, FBD may be responsible for treatment (alone or  co-responsible with a teaching) or a simple subcontractor.

 

2.2. FBD  can also receive your Data  indirectly, through partners to whom you have entrusted your Data. Thisis the case, for example, when you ask for information about  our  Networks from organizations such as the French Franchise Federation or the franchise observatory or when you exchange with a recruitment firm for a position to be filled within FBD or one of our Signs.  

 

FBD is careful to remind its partners of their obligations under the Regulations, but cannot be held responsible for their actions when they act as a processing manager.

 

2.3. Finally,  FBD  can automatically collect your Data through your browsing tracks on  the  Site, if you have accepted it (acceptance of cookies).

 

  1. What Data Uses FBD and for What Purpose?

As part of the requests you make through the Site (contact request,canidatures)  or the social networking pages of FBD,  FBD and its Enseignes  systematically collect your civility, your name, your first name, your email and possibly, depending on the purpose of your application, your postal address and your phone number.

Additionally and more specifically in the cases detailed below, additional data is processed by FBD  and/or  a Sign.

    1. If you are applying to join FBD or a Company as an employee

When you apply to join FBD  or a Teacher as an employee, you will be providedwith the following data onthe Site:  

  • contact information and   information about your marital status (civility, name, first name, email, phone, postal address)  
  • information about your training (training, institutions, diplomas, year of obtaining...)  ;
  • information about your professional experience and skills (CV, experience in management, business management, IT, business...)  ;

These data are:

  • jointly handled by FBD  and the Teacher  (co-treatment managers) when you apply for a position within a Teaching;  
  • exclusively treated by FBD if you are applying for a position with FBD International, as a draft manager.
    1. If you are applying to join the company of one of our Networks

When you apply to join one of the  companies of our Networks members,  you will  be providedwith   the following  data: 

  • contact information and   information about your marital status (civility, name, first name, email, phone, postal address)  
  • information about your training (training, institutions, diplomas, year of obtaining...)
  • Information about your work experience and skills(CV, cover letter, etc.)
  • information about your professional ambitions.

 

When you apply for the FBD  Site to join the company of one of our Networks members,the Data is transmitted by  FBD  to the company  fromwhich you wish to apply. This  company is then solely  responsible for the processing of your Data, in its capacity as a processing manager,FBD acting as a subcontractor.

 

    1. If you are applying to join one of our Networks as a distributor

When you apply to become a member of one of our Networks, you provide the following data:

  • contact information and information about your marital status (civility, name, first name, email, phone, postaladdress)
  • Information about your family situation
  • information about your training (training, institutions, diplomas, year of obtaining...)  ;
  • information about your professional experience and skills (CV, experience in management, business management, IT, business...)  ;
  • information about your project to become a member of one of our Networks  (motivations, expectations, nature of the projected project, desired location...)  ;
  • information about your financial situation (personal capital available, how to finance the project, participation in companies...).

Thisdata  is processed  by  FBD and the teacher concerned,in itscapacity as the processing manager, in   order to allow it to take into account and study your application to integrate its network.

 

    1. If you interact with FBD via social networks
  • contact information and information about your marital status (civility, name, first name, email, phone, postal address)
  • information about the purpose of your request and/or comments.

Your messages and publications to FBD  should not include sensitive data such as information about racial or ethnic origin, political opinions, sexual orientation, religious, philosophical or union affiliation.

This data is processed by FBD  to communicate with you and answer your requests and/or questions.

    1. If you browse the Sites

When you use the   Sites,  login data (cookies, log files) is collected by  FBD,including:  

  • information about your use of the site concerned (your login time, time and day of connection, your IP address, your login mode, the type and version of your internet browser...)  ;
  • information about your equipment (your operating system, your unique device ID...)  ;
  • information than the queries you make on the Site.

  1. The legal basis forFBD Data treatments

 FBD  collects your on the basis of four foundations:

 

  • The legitimate interest:

Some data processing can be carried outon the basis oflegitimate interest (forexample to take into account your applications,  to answer your requests and or questions made through socialnetworks,  contact requests ... ).

 

  • Your consent:

FBD asks  for your consent for any other data collection that does not correspond to previous cases (e.g.  online form, newsletter). This consent may be materialized by a check box or by a positive act on your part of communicating data to  FBD  for the stated purpose.

 

             

  1. Preservation times

Your Data is kept for the following periods:


Data collected as part of a request via the Sites.

> 3 years from the date of the last contact with you.

Data collected as part of an application to join one of our Networks as a distributor.

> 3 years from the collection of your Data when your application has not received a favourable outcome or for the necessary period when your application leads to your integration into one of our Networks.

Data collected as part of an application to join FBD International or a Brand.

> 2 years from the collection of your Data when your application has not resulted in a hiring or for the necessary time when your application leads to a hiring.

Data collected as part of your browsing on the Sites.

> 13 months from the day of collection.

 

6. To whom does FBD transfer your Data?

FBD does not transfer your Data to third parties. For FBD, this is the basis of a relationship of trust.

However FBD shares some of your Data with the following partners:

  • Its Networks;
  • companies that support FBD or Ensigns for their recruitment;
  • companies approved by you, such as social networks (if you choose to link your accounts with FBD).

These partners may have their own personal data processing policy that FBD suggests you consult.

 

FBD may also transmit your Data to the competent authorities requesting their communication, in accordance with the regulations in force.

 

7. The rights you have

In accordance with the Regulations, you have the following rights:

  • request access to your Data;
  • request the rectification of your incomplete or inaccurate Data;
  • request the erasure of your Data (provided that FBD does not have a legitimate and compelling reason to keep it);
  • object to the processing of your Data;
  • request the limitation of the processing of your Data;
  • request the portability of your Data (please note, however, that this right applies only to the computerized data that you have provided).

You also have the right to set guidelines on the fate of your Data after your death.

FBD will record these instructions and, if FBD learns that such an event has happened, will process your Data in accordance with your wishes.

When requesting the exercise of one of your rights, FBD may, in accordance with the Regulations in force, ask you for additional information that appears necessary to verify your identity.

8. The security and confidentiality of your Data

FBD puts in place appropriate technical and organizational measures, taking into account the nature of the Data and the risks that their processing entails, in order to preserve the security, integrity and confidentiality of your Data and in particular to prevent it from being distorted, damaged, lost or communicated to unauthorized third parties unless the communication of this data is required by the regulations , in particular at the request of a judicial, police, gendarmerie or any other authority empowered by applicable law.

These measures include:

  • limit access to Data concerning you to employees of FBD and The Brands who really need it for the performance of their duties, to provide you with products or services, the contractual guarantees you benefit from or to respond to your requests;
  • raise awareness among all FBD staff and brands of data protection and security;
  • deploy an information systems security policy;
  • deploy an incident management policy;
  • deploy an asset rebusting procedure;
  • secure its Sites;
  • secure its premises as well as computer servers (secure access, authentication process, antivirus, firewall...);
  • Deploy regular COMPUTER backups to prevent any risk of loss or deterioration.

 

9. Data Protection Policy and Minors

The Sites are not intended for minors under the age of 18 (hereinafter the "Minors") but remain accessible to them to the extent that they do not present content prohibited to Minors.

The forms on the Site are not intended to collect Data on Minors. The minor's legal representative may contact the gdpr@fdbgroup.fr address to exercise the minor's rights, in accordance with the procedures set out in Article 7 of this data protection policy.

 

10. Your remedies

FBD pays particular attention to protecting and respecting your privacy. If you are not satisfied with the way in which FBD or a Brand processes your Data, if you wish to exercise any of your rights or if you have any questions about the way in which FBD and the Brands process your Data you can write to the address gdpr@fbdgroup.fr.

If you believe, after contacting FBD, that your rights are not respected, you can send a complaint to the Commission Nationale de l'Informatique et des Libertés(https://www.cnil.fr/).

 

11. Changes to the data protection policy

In order to always comply with the Regulations, FBD will have to modify this data protection policy.

FBD advises you to regularly consult this page to be aware of any changes or updates made to this data protection policy.

  1. To whom FBD transfera your  Données? 

FBD does not cede your data to third parties. This is the basis of a relationship of trust for FBD.  

However, FBD  shares  some of your  Données with the  following partners:

  • Its Networks;
  • Companies that accompany FBD or the Ensigns  for  their  recruitment;

FBD will record these guidelines and, if FBD learns that such an event has occurred, will process your Data in accordance with your wishes.
